Preamble
These Terms and Conditions of Use (βCGUβ) and Terms and Conditions of Sale (βCGVβ) govern access to and use of the Respectful Markets platform (the βServiceβ), operated by Respectful Markets SAS. Any registration or order implies full and unconditional acceptance of these terms.
Article 1 β Definitions
- Platform: the website and all services accessible from respectfulmarkets.com.
- Operator: Respectful Markets SAS, operator of the Platform.
- Seller: any professional or individual registered to offer products for sale.
- Buyer: any natural or legal person making a purchase on the Platform.
- User: Buyer or Seller indiscriminately.
Article 2 β Purpose
Respectful Markets is an online marketplace connecting third-party Sellers (brands, resellers, individuals) with Buyers. The Operator is not the seller of the products, unless expressly stated otherwise.
Article 3 β Registration and account
Registration is free. The User undertakes to provide accurate, complete, and up-to-date information. The User is solely responsible for the confidentiality of their login credentials. Any account opened by a minor under 15 requires parental authorization.
Sellers are subject to an identity verification procedure (KYC): proof of identity, bank account details, extrait Kbis (where applicable). The Operator reserves the right to refuse or suspend any registration.
Article 4 β Products and descriptions
Sellers are solely responsible for the information relating to the products they post online (photos, description, price, stock, legal compliance). The Operator guarantees neither the accuracy nor the availability of listings.
The following are strictly prohibited on the Platform: counterfeit, unlawful, dangerous products, products infringing human dignity or the rights of third parties, weapons, drugs, prescription medicines, protected species, etc.
Article 5 β Prices and orders
Prices are indicated in euros (β¬), all taxes included (TTC), excluding delivery costs, which are specified before the order is confirmed. The sales contract is concluded between the Buyer and the Seller; the Operator acts as a technical intermediary and collects payments on behalf of the Seller.
Article 6 β Payment
Payments are secured by our provider Stripe (Stripe Connect). Accepted methods include bank cards (Visa, Mastercard) and other methods displayed at the time of payment. The Operator transfers to the Seller the amount due, less the commission.
Article 7 β Commission and fees
The Operator charges a commission on each sale made via the Platform, the rate of which is specified in the Seller agreement. Optional subscriptions and promotional services (sponsorship) may also be offered.
Article 8 β Delivery
The Seller undertakes to ship the products within the displayed timeframes. Tracking information is sent to the Buyer by email. In the event of a clear delay or non-delivery, the Buyer may contact support for a refund.
Article 9 β Right of withdrawal
In accordance with article L.221-18 of the Code de la consommation, the consumer Buyer has a period of 14 days from receipt of the product to exercise their right of withdrawal, without having to give reasons for their decision.

Exceptions to the right of withdrawal: personalized products, perishable goods, unsealed goods that cannot be returned for hygiene reasons, downloaded digital content, etc. (article L.221-28).
Article 10 β Legal guarantees
The Buyer benefits from the legal guarantee of conformity (articles L.217-3 et seq. of the Code de la consommation, duration 2 years) and the guarantee against hidden defects (article 1641 of the Code civil).
Article 11 β Liability
The Operator acts as a hosting provider within the meaning of the LCEN with regard to content published by Sellers. Its liability may not be engaged on account of products, the conduct of Sellers or Buyers, except in the event of a proven breach of its own obligations.
Article 12 β Personal data
The processing of personal data is described in our Privacy Policy, in compliance with the GDPR and the French Data Protection Act.
Article 13 β Suspension and termination
The Operator reserves the right to suspend or close any account in the event of a breach of these terms, fraudulent activities, or endangerment of other Users.
Article 14 β Amendments
The Operator may amend these at any time. Users will be notified of any substantial change. Continued use constitutes acceptance.
Article 15 β Applicable law and jurisdiction
These are governed by French law. Any dispute shall be brought before the competent courts within the jurisdiction of the Operator's registered office, unless mandatory provisions applicable to consumers provide otherwise.
